State aid

Area of expertise

Free-market competition can be distorted not only by companies but also by the actions of public authorities.

As a rule, unless exempted, the EU law prohibits the granting of state aid by EU Member States and their agencies. Specific exceptions to this rule are set forth in the applicable legislation.

Experience

Hansberry Tomkiel advises clients who have received state aid as well as clients who wish to challenge the grant and use of unlawful state aid by their competitors.

Our recent experience includes:

  • presenting our client’s position before UOKiK;
  • assessing whether the support granted complies with state aid legislation;
  • representing one of our clients before the EU Court of Justice in proceedings concerning the granting of state aid.
