Area of expertise

To guarantee compliance of products subject to the free movement of goods in the EU with the requirements for protecting public interests, such as general health and safety, consumer protection, etc., legislation has been implemented at EU and national levels to set out the terms of market supervision and, in particular, the rules of conformity assessment, market supervision, inspection of products from third countries and CE marking.

Lack of compliance with the applicable law may lead to consequences as drastic as being ordered to recall a product, discontinue its use, and/or being fined.

The name of a product that does not conform to the requirements will listed in the publicly available Register of Non-Conforming or Potentially Hazardous Products, which is maintained by the President of the Office of the UOKiK.

Experience

Experience with market supervision:

  • Designing and conducting workshops and trainings that are tailored to the applicable law and to the business environment of our clients. The market supervision system consists of authorities who have specific competences including conducting audits. It is vital that companies have knowledge of the competences and of the scope of activities of such authorities;
  • Representation in proceedings before market supervisory authorities and the President of UOKiK, the agency responsible for monitoring the functioning of the market supervision system;
  • Representing clients in administrative court proceedings.
