Area of expertise
It is important to know that even those products for which no specific safety requirements are legislatively mandated are nevertheless subject to the provisions of the Act on General Product Safety.
The lack of a product’s conformity with the Act on General Product Safety may lead to serious consequences. The authority responsible for supervising general product safety is the President of UOKiK.
Lack of compliance with the applicable law may lead to consequences as drastic as being ordered to recall a product from the market or being fined. The name of an unsafe product will be listed in the publicly available Register of Unsafe Products.
Experience
Experience with general product safety:
- Representing clients in proceedings before the President of UOKiK;
- Representing clients in proceedings before administrative courts;
- Drafting legal opinions;
- Assessing whether a client’s procedures are legally compliant;
- Drafting compliance procedures;
- Conducting workshops and trainings for clients.
